Terms of Service
1. Acceptance of Terms
By accessing or using the Maliyon platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use our services. By using our platform, you represent and warrant that you meet all eligibility requirements.
3. Account Registration
You are responsible for maintaining the security of your account and any activities that occur under your account. Maliyon is not liable for any loss or damage arising from your failure to comply with this security obligation.
4. Token Purchases
All token purchases are final and non-refundable. Tokens represent fractional ownership in specific assets and are subject to the terms outlined in the respective offering documents.
5. Compliance with Laws
You agree to comply with all applicable laws and regulations, including tax laws and securities laws in your jurisdiction. It is your responsibility to determine whether your use of our services is legal in your jurisdiction.

Privacy Policy
1. Information We Collect

Regulatory Compliance
1. DFSA License
Maliyon is licensed by the Dubai Financial Services Authority (DFSA) to operate a platform for dealing in investments, with specific approval for security token offerings. Our license number is DFSA-MLY-2024-001.
2. Anti-Money Laundering (AML)
We maintain a comprehensive AML program that includes customer due diligence, transaction monitoring, and reporting of suspicious activities to the appropriate authorities. All investors must complete KYC verification before participating in any offerings.
3. Know Your Customer (KYC)
Our KYC process requires government-issued ID verification, proof of address, and in some cases, accredited investor verification. This helps us prevent fraud and ensure compliance with regulatory requirements.
4. Sharia Compliance
Our tokenization structure has been reviewed and certified by the Sharia Advisory Board, confirming compliance with Islamic finance principles including asset-backing, profit-sharing, and prohibition of interest-based returns.

Risk Disclosures
1. Market Risk
Real estate markets can be volatile and subject to fluctuations based on economic conditions, interest rates, and other factors. Property values may decline, resulting in losses for token holders.
2. Liquidity Risk
While we provide a secondary market for token trading, there is no guarantee that you will be able to sell your tokens at any particular time or at a favorable price. Secondary market liquidity depends on buyer demand.
3. Regulatory Risk
Changes in laws or regulations could adversely affect our business operations or the value of tokenized assets. This includes potential changes in securities laws, tax laws, or blockchain regulations.
4. Technology Risk
Our platform relies on blockchain technology, which may be subject to security vulnerabilities, network congestion, or other technical issues. Smart contracts, while audited, could contain bugs or exploits.
5. Operational Risk
Property management, tenant issues, or other operational factors could affect rental income and distributions. We maintain professional property managers to mitigate these risks.

Governance Framework
1. DAO Structure
The Maliyon DAO enables token holders to participate in governance through on-chain voting. Voting power is proportional to MLY tokens staked in the governance contract.
2. Proposal Process
Token holders can submit proposals for new asset acquisitions, protocol upgrades, treasury allocations, and other governance matters. Proposals require a minimum of 100,000 MLY tokens to submit and undergo a 7-day voting period.
3. Multi-Signature Treasury
The platform treasury is controlled by a multi-signature wallet requiring 3 of 5 authorized signatories to approve transactions. Signatories are elected by the DAO annually.
4. Dispute Resolution
Any disputes arising from platform operations are first addressed through the DAO governance process. Unresolved disputes may be referred to arbitration in accordance with DIFC-LCIA rules.
